一个解决WTO上诉机构僵局的设想

作为WTO"王冠上的珍珠"的争端解决机制因为美国的阻碍导致上诉机构成员不能被任命而陷入僵局,如此种情形持续,WTO的争端解决功能将于2019年年底发生瘫痪。本文介绍并评估了现有关于如何走出僵局的若干建议,在此基础上提出自己相对独特的建议,即在WTO框架之外建立一个与现有的争端解决机制并行的超大型争端解决机制,并论证了该提案在法律上的可行性,最后呼吁立即开始这项新的上诉机构所需的大型协议的谈判。
