《国际法院规约》第38条是讨论国际法渊源问题的出发点,其直接来源是《常设国际法院规约》第38条。此条在制定过程中,主要经历了法学家咨询委员会阶段和国际联盟行政院与大会阶段。在此过程中,本条各项规定均有不同程度的调整与修改。准确、全面地了解本条各项规定的起草与修正过程,有助于更好地认识和评价国际法诸渊源的作用与功能。
