摘要
2010年南海本田事件后,因工资增长诉求引发的一系列工人行动表明,传统的党政主导下形式型集体协商已经无法解决工人的工资增长诉求,自主工资集体协商成为解决集体争议的必由之路。在我国,自上而下党政主导型和自下而上工人行动推动型是工资集体协商两种主要启动形式。对中国最大的挑战是工人行动之后,如何构建可持续的工资集体协商制度。在2 010年南海本田事件的传导效应下,瑞鸿企业通过工人行动实现工资集体协商。随后,在工会努力下,通过工会民主制度的构建、工会代表性构建以及协商流程化与规范化构建,形成了每年一次的工资集体协商惯例,建立起工会主导下制度化的工资集体协商,为解决集体劳动争议,建立和谐劳资关系提供了经验。
