论大数据时代欧美雇员信息隐私权立法模式

摘要
雇员的信息隐私权利与雇主以及第三方合法权利存在冲突。由于大数据等科技增强了雇主的监控能力,雇员信息隐私边界模糊,传统的雇主告知、雇员同意原则已难以保障雇员的信息隐私利益。美国对雇员信息隐私保护采取的是多视角分散立法模式,主要从反歧视视角、侵权保护视角、雇员结社视角制定相关法案,再辅之以各州单独立法补充,实现保护雇员隐私的目标。欧盟则采单一立法模式,辅之以细则及判例。美国与欧盟的雇员隐私立法都具有实用主义倾向,都基于情境以一种灵活的方式判定是否需要法律介入保护雇员信息隐私。我国未来立法应借鉴欧美经验,为实现雇员信息隐私利益与雇主利益的平衡,坚持灵活、务实以及以目的为导向的信息隐私保护立法原则。
