实践权威能够创造义务吗?

摘要：

在概念上,政治权威包括"服从(法律)的义务",并且理论家通常借助实践权威而非理论权威的概念对此加以说明,因为他们一般都同意实践权威具备创造义务的能力这个观点。由于实践权威处于理由和义务的中间位置,因此,这是一种"理由进—义务出"的论证模式,拉兹的服务权威观(尤其是通常证立命题)被认为是对此最有力的说明。然而,一旦注意到权威结构中的不对称性这个要素,那么一方面,就没有理由排除用理论权威对政治权威之性质的说明;另一方面,实践权威也不具备制造"理由进—义务出"的效果。因此,从总体上而言,实践权威并不具备创造义务的能力。
