摘要：

在全球化背景下,世界银行的权力和影响力不断扩张,在全球减贫、维护世界金融稳定、促进全球治理等方面世界银行都是举足轻重的参与方。最近二十年来,世界银行在打击全球腐败方面的努力不胜枚举,特别是在1996年正式引入的反腐败制裁制度,是世界银行参与全球治理的一个引人瞩目的方面。经过数次全面改革,世界银行不断扩大反腐败管辖范围,强化调查和制裁能力,提高制裁的强制性,同时规范制裁程序并使之趋于准司法化。通过对反腐败制裁机制的强化和完善,在全球治理的语境下,世界银行在反腐败方面正在逐步转型为公共机构,行使国际社会中的"准公权力",其权力和影响力进一步扩张和正当化。在全球治理的话语体系下,在国际层面,一种形式主义的法治话语正日益成为国际组织建构权力、拓展管辖和赢取正当性的重要路径和工具。
