研究专利维持时间的影响因素对提高专利制度的运行绩效非常重要。技术领域和专利族等是影响专利维持时间的技术性因素;专利维持年费制度、保护范围、创造性标准和专利侵权的认定方式等是影响专利维持时间的制度性因素;专利管理制度和专利战略等是影响专利维持时间的创新主体因素。
