欧盟共同决策程序的变革——以“三方会谈”为例

摘要：

共同决策程序是欧盟立法程序中最重要的程序。由于实际工作的需要,共同决策程序在具体实践中逐渐发生了变革:虽然条约对共同决策程序的规定(正式规则)界定了主要参与者的行为框架,但是大量的"三方会谈"即欧洲议会、部长理事会和欧盟委员会之间的非正式会议往往是共同决策程序达成协议的关键。"三方会谈"导致大量早期协议产生,有利于提高欧盟的立法效率;非正式规则的"三方会谈"影响正式规则,导致新的制度变迁;但是,"三方会谈"也对欧盟民主产生了不利影响。随着共同决策程序适用范围的进一步扩大,为了提高立法效率,未来非正式的"三方会谈"的应用频率还会不断增加。
