摘要：

社会矛盾在局部地区激化的现实,暴露出我国现行刑事司法制度存在不应回避的缺陷,并对我国刑事司法提出了新的挑战。司法是社会治理和法治路径有效衔接的关键性要素,通过司法的社会良性治理是法治社会的基本表征。透过对典型个案的观察,在理性选择的分析框架下,参与式治理、自主治理和多中心治理理论能为我们解释极端社会矛盾和缓解社会冲突提供思路,为相关司法制度改革提供理论支撑和方向指引,以便构建符合社会治理理念和司法规律的纠纷解决机制。
