摘要：

反不正当竞争法与反垄断法的关系具有重要的理论及实践意义。一般认为,规范不正当竞争行为的反不正当竞争法是公平竞争法,规范垄断行为的反垄断法是自由竞争法。但从海外有关国家(地区)经验来看,若干反竞争行为同时兼具不正当竞争和垄断行为色彩,其法律调整也往往同时涉及反不正当竞争法和反垄断法。我国《反不正当竞争法》中的若干垄断条款可以经过修改后存留,亦可考虑在《反垄断法》修订时予以体现。
