Just as Professor Qin Hui pointed out that, in traditional China,the state had been coming into being as the supreme value,however,the clannish ethical principles implied within Confucianism had all the time been the fundamental constructing material for public sphere.The nationalistic appeal implied in this communitarian ethic which had been originated from the rationalization of nationalistic historical narration had rendered the universal and transcendent appeal inherent in natural law tradition obsolete.Failing of protection of this transcendent value,liberty,democracy and individual right,etc., would be doomed ineffective by assorted secular values.Therefore,the ethic of “Big” community and “Small” community is necessarily challenge confronted by the development of civil society in China today.
