从“南北矛盾”到“公私冲突”:卡尔沃主义的复苏与国际投资法的新视野

摘要：

统治拉美乃至世界已有一个多世纪的卡尔沃主义,并非普遍认为的已经"死亡"。近来在拉丁美洲内外的一系列事件表明卡尔沃主义没有死亡,而且正在逐渐复苏,这也从侧面反映了当代国际投资法的重大转向。通过探寻这一系列事件,分析卡尔沃主义在何种程度上已经复苏,国际投资法理念在发生怎样的变化;并在批判分析卡尔沃主义与新自由主义两种制度弊病的基础上,探讨国际投资法的前景和出路;认为国际投资法的立法焦点已由过去的"强国"与"弱国"的对立,即"南北矛盾",转变为如今的"国家主权"对"公司主权"的对立,即"公私冲突",缔结一个利益均衡的全球性的投资条约将为期不远。
