2015-2016年屡遭恐怖袭击的欧盟,将如何回应外国恐怖主义战斗人员的棘手问题作为后巴黎-布鲁塞尔时期反恐法的重点。为了追求安全目标,这一阶段欧盟推出的《乘客姓名记录指令》和《欧盟打击恐怖主义指令》体现了以无差别大规模监控为手段、以情报为基础、以主观危害性为可罚性标准的反恐法预防性转向。欧盟反恐法的这一趋势动摇了传统刑法的目标和原则,改变了刑事合作的模式。欧盟反恐法的预防性转向不乏正当性,但也要引起警惕并加以约束。在维护反恐法的重要原则、尊重人权的基础上,将预防作为辅助标准,针对欧盟反恐法的局限性发挥补充作用,是对预防性转向的合理规制。
