摘要：

食品安全保障问题不仅关乎公民健康权以及各国的贸易利益,也取决于科技水平的高低,故各国国内食品安全保障措施差异较大,很难采取硬法方式进行统一规范,由此催生软法的适用来对差异性加以弥合。但在现行食品贸易体制对各国利益分配不均的大背景之下,一方面由于国际软法制定过程隐藏的"权力导向",另一方面由于WTO规则尚不周延,争端解决机制本身也存在缺陷,以致WTO食品贸易争端中国际软法适用分歧频现。为使食品安全国际软法能够在WTO争端解决中发挥更好的作用,我们应当努力从遏制食品安全国际软法制定过程中的"权力导向"、明确WTO争端解决机制中第三方举证权限等方面,努力消解WTO争端解决中食品安全国际软法适用的分歧。
