摘要：

从时间维度看,环境权国际进程大致可以分为三个阶段,即萌芽阶段、政治认可阶段和法律确认阶段;从问题维度看,环境权国际进程主要聚焦五大问题:第一,环境与人权之间是什么关系?第二,确立独立类型的环境权从理论上和实践上是否是必要的?第三,环境权的内涵如何界定?第四,环境权应该优先保障程序权还是实体权?第五,环境权是否属于"第三代人权"的范畴?环境权国际进程带给我们的启示是:在实体权利争议难以短期内得到妥善解决的背景下,应切实推进环境知情权、环境参与权、环境请求权等程序性环境权的发展,并通过程序性权利的发展催生实体性权利的最终成熟。
