《国际刑事法院罗马规约》浅析

This article makes preliminary analyses on the jurisdiction, complementary principle, roles of the prosecutors and judges and judicial assistance stipulated in the Rome Statute. It also expounds the reason why China voted against the adoption of the Rome Statute: the incompatibility of the Chinese domestic law and binding force of the Statute upon the third party. The International Criminal Court, therefore, may become a super national court of appeal above the national criminal jurisdiction.
