领导意愿、机构能力和司法公开——北京、上海、广东裁判文书上网率的初步研究

摘要：

北京、上海、广东三地法院的裁判文书上网率不高,在全国省级法院中排名靠后,其原因不在于最高人民法院裁判文书上网要求的权威度不够,而在于该要求不能得到持续执行。此外,裁判文书上网的意愿不足、能力受限都是北上广法院上网率不高的原因。就后者而言,北上广法院审理的案件量大、案件复杂程度高,制约了裁判文书上网的能力。
