摘要：

本文通过规制干预、刑事司法、国家安全、公共部门管理与财政领域的案例,论证了风险概念在英国公共行政中递增的重要性,着重强调风险应对能力被内阁与财政部赋予的核心地位。本文揭示了风险规制领域的发展对行政法的挑战,并特别探讨以下内容:(1)公共行政规制中非法律模型的角色;(2)专门技能与专业知识的作用;(3)法律与合法公共行政理论的关系。文章通过引用美国法官在环境保护与公共健康背景下对技术行政决定的司法审查判决,据此说明风险共同体对行政法律人的实践意义。
