摘要：

Bayh-Dole法案曾经被认为是提高美国大学专利申请和专利转让活动的核心因素。Bayh-Dole法案促进技术转移的模式是否适用于其他国家,引起了学术界和政策制定者的广泛讨论。本文系统地回顾了Bayh-Dole法案运行30周年以来国际学术界的研究。从对这些文章研究内容、方法和视角的变化的分析可以看出,以2005年为界,学术界经历了从对法案有效性的实证分析到关注法案理念和政策设计路径研究的转向。通过文献分析和对相关理论及政策问题的探讨,本文旨在形成对Bayh-Dole法案更系统的理解,也为我国完善政府投资科研成果的知识产权归属问题的政策体系提供启示。
