摘要：

国际软法本身虽然不具有直接法律约束力,但是在规范国际关系方面起到了积极作用,能够产生一定法律效果。国际软法的兴起不仅与国际社会面临的各种复杂问题有关,也与传统国际立法模式无法有效适应变动的国际社会有直接关系,是多种因素共同作用之结果。国际软法的兴起是全球治理时代在各个"权威领域"追求"规则体系"的反映。
