法实证主义的概念分析是以命题的形式来展示关于我们的法律实践的某些本质的、重要的、令人感兴趣的方面,它指向的对象是law,而非对"law"的语词分析;它是关于法性质的判断,揭示了法律实践的某些实质的方面,呈现出了关于law的概念性定义;它也许是具有普遍性的,但主要是地方性的,是关于"我们"的法律实践的判断。概念分析内在包含了对法理论的建构,其基础是法律实践。分析法学的法理论建构采取实践参与者的视角,是对法律实践的二阶诠释,二阶诠释的本意就是判断法律实践的重要性。
