从知情同意到共同决策:临床决策伦理的范式转移——从Montgomery案例切入附视频

摘要：

知情同意颠覆了传统的家长主义范式,彰显了对患者主体性的尊重,然而对于同意偏狭的解读决定必然残留父权主义的痕迹。其价值预设的先天缺陷,导致对现实解释能力的逐渐枯竭。英国的Montgomery案的发生深刻地诠释了这一现象,最高法院的判决是对该现象的修复与纠正,并确定了医患共同决策作为医疗决策范式的合法性。传统一体通用的知情模式日渐式微,而被医患共同决策模式所替代。共同决策模式对知情同意的超越体现在:医患的主体间性是对单主体性的超越,是信息共享对价值单向度流动的超越、是对话模式对告知模式的超越。
