政策过程视角下的政府参与国际规则制定

传统国际政治理论在分析不同国家参与国际规则制定行为方面有一定的局限性。作者力图借鉴公共政策过程理论的分析框架来分析国际规则形成的过程,以《保护和促进文化表现形式多样性公约》(简称《公约》)作为分析对象,在运用政策过程分析框架解构该公约形成和实施的过程中,重点解释了《公约》形成过程中的两个问题:其一,文化产品与服务的贸易问题没在世界贸易组织框架下解决,却在联合国教科文组织的平台上发展为国际公约。其二,"文化多样性"理念在21世纪初得到各国政府的积极支持,《公约》自2007年开放缔约以来,各国政府的缔约和履约情况却不理想。研究发现,政府的高参与意愿以及在国际组织的运作能力促使文化多样性议题进入联合国教科文组织的议程设置平台;部分政府本土政策环境不佳导致《公约》内容制定趋于抽象;本土官僚机构统筹协作能力欠缺则影响了《公约》的实施效果。这启示中国政府参与国际规则制定时,既要认识到参与意愿在议程设置阶段的重要性,也要致力于提高政府能力从而使规则内容制定和实施真正对国家有益。
