欧债危机下欧盟经济治理与财政一体化的立法进展

欧洲主权债务危机暴露出欧盟在经济治理上,尤其在财政监管上存在重大缺陷。长期以来,对马约中早已达成的预算和财政纪律,欧盟缺乏具有执行力的法律监管框架。在危机压力下,欧盟通过包括"六部立法"和"财政契约"在内的一系列法律措施,开始了加强经济治理、强化财政纪律和加大惩罚机制的进程。尽管,"财政契约"仍然是加强版的经济与货币联盟,却表现出了财政一体化的端倪。本文通过聚焦2011年以来的欧盟经济治理与财政监管立法进展,对欧盟新一轮制度建设进行全面梳理。当前,欧盟在危机之下被迫进行的制度建设,其影响和意义将远远超出经济治理的范围。欧盟正处在继续推进宪政的关口。
