摘要：

设立国际商事法庭成为当下国际商事纠纷解决领域中的一种"新生态"。2018年4月德国联邦众议院公布了《引入国际商事法庭的立法草案》,希冀在德全境州中级法院引入国际商事法庭并以英语作为审判语言。引入国际商事法庭将对德国现行《法院组织法》和《民事诉讼法》作出制度性改变。从国际比较的视角来看,其与广为悉知的国际商事法庭皆有不同,是德国商事法庭传统性与国际商事纠纷解决现代性的结合。
