The clinical investigator as fiduciary: Discarding a misguided idea

Many commentators insist that clinical investigators are fiduciares of research subjects, owing the same duties that physicians owe their patients. This essay argues that investigators can not possibly be fiduciaries. Nevertheless, they still have strong obligations to protect volunteers' welfare, best understood as "side constraints".
