司法独立与金融发展——来自中国的经验证据

摘要：

政府对金融市场的过多干预弱化了金融在现代经济中的核心作用。理论上,司法独立性的提升有助于制衡行政权力的过度扩张,提高政府保护契约自由和财产权利承诺的可信度,进而促进金融发展。本文以2008年法官异地交流作为刻画地方司法独立提升的一次自然实验,研究发现地方司法部门独立性的提升显著地促进了金融发展。同时,司法独立也影响了银行贷款的期限结构,显著地促进了长期信贷市场的发展。这给实现市场化改革提供了有价值的参考。
