摘要：

公平是法律的价值追求之一,也是评价政策合理性与否的重要考量因素。然而,公平具有多重意蕴,环境正义已经从传统国内分配正义发展到全球环境正义,"共同但有区别的责任"原则是公平原则的具体化。国际视野下碳排放权的分配应当坚持国内公平与国际公平并重,坚持实质公平优于形式公平,坚持社会公平重于经济公平。欧盟航空碳排放税的本质是碳关税,具有"总量交易""分权治理"和"开放可控"的特征。欧盟航空碳排放税属于单边行为和新型贸易壁垒,违反了"共同但有区别的责任"原则。中国应在积极推动国际航空碳排放体系构建的同时适时开征碳税,尽快构建本国的碳交易市场。
