摘要：

当下我国社会运行的主要矛盾在于社会公共事务的日趋复杂与传统社会管理模式功能局限间的紧张。它决定了社会建设必须从管理向治理转变。治理具有主体多元性与关系多向度性、内容广泛性与对象深层次性、系统高共识性与成员强认同感等特征,其价值取向是"以人为本",其中心目标是治理有效。社会治理必须透过法治保证治理系统内在协调、稳定主体间互动预期和防范治理陷阱。法治建设要作出针对性回应:立法要高度重视科学制定框架规则和责任体系,行政重心要从程序合法转向实质有效,司法要透过能动回应,抵御"过度民意化",强化权威。
